Buildwithaplan LLC (“Company,” “we,” “us,” or “our”) operates buildwithaplan.com and provides accessory dwelling unit (ADU) feasibility, design, permitting, and referral services (the “Service”). This Privacy Policy describes how we collect, use, and share personal information through the Service, including our free feasibility tool, intake forms, checkout, and marketing.
1. Personal information we collect
We collect the following categories of personal information, primarily through the intake and feasibility forms on the Site:
- Contact data: your name, email address, and phone number.
- Property data: the property address you submit for feasibility screening, and any project details, timeline, or budget range you provide.
- Communications data: records of your calls, emails, and chat conversations with us or our AI chat assistant.
- Files you upload: photos, sketches, surveys, or other documents you attach to your intake submission, stored via our cloud file storage provider.
- Transactional and payment data: if you purchase a self-serve design package through the Site, our payment processor (Stripe) collects and processes your payment card information directly — we receive your order details and a payment confirmation, not your full card number. If you purchase the Backyard Wealth Package by phone, your card is collected via a Stripe payment link after your signed order confirmation.
- Device and usage data, collected automatically — see Section 2 (Cookies and Tracking Technologies) and our Cookie Notice.
We do not currently offer user accounts or logins, so we do not collect or store account passwords.
2. Cookies and tracking technologies
We, and the following service providers, use cookies and similar technologies on the Site:
- Google Analytics 4 — site usage and traffic analytics.
- Microsoft Clarity — session-replay and heatmap analytics, to help us understand how visitors use the Site.

3. AI chat assistant
The Site includes an AI-powered chat assistant. Messages you send it, and the property or project details you share through it, are processed to generate a response and may be shared with our AI service provider(s) to operate that feature. [CONFIRM: name the specific AI model provider(s) powering the chat backend and confirm their data-retention and training-use terms, so this section can name them and state plainly whether your inputs are used to train third-party models.]
4. How we use your personal information
- Service delivery. To run your free Feasibility Study, respond to your intake, schedule and conduct sales calls, prepare and deliver your design and permit documents, and manage permit submissions on your behalf where you have authorized us to.
- Communication. To send you your feasibility results, project updates, and, if you don’t opt out, marketing about our services.
- Service improvement. To understand how visitors use the Site and improve it, using the analytics tools described in Section 2.
- Compliance and protection. To comply with law, enforce these terms, and prevent fraud or abuse.
5. How we share your personal information
- Service providers who host the Site and process data on our behalf, including Cloudflare (hosting, database, file storage), Cloudinary (image hosting), Resend (transactional email delivery), Stripe (payment processing), and our AI chat provider(s).
- Financing and construction Partners you ask us to connect you with — we share the property and project details necessary to make that introduction, only with your knowledge that the introduction is happening.
- Professional advisors such as our attorneys and accountants, in the course of the services they provide us.
- Authorities where required by law, subpoena, or to protect our or others’ rights and safety.
- Business transferees, if the Company is involved in a merger, acquisition, financing, or sale of assets.
We do not sell your personal information for money.
5A. Text messaging privacy
If you separately opt in to a Buildwithaplan LLC text-message program, we use your mobile number and consent record to send only the categories of messages you selected. Transactional and customer-care messages may include inquiry responses, feasibility results, appointment reminders, and project updates. Marketing messages may include ADU planning resources, service announcements, and special offers.
You may opt out at any time by replying STOP. Reply HELP for help, or email hello@buildwithaplan.com. Message frequency varies for project and customer-care updates; marketing messages are limited to four per month. Message and data rates may apply. Consent is not a condition of purchase.
All the above categories exclude text messaging originator opt-in data and consent; this information won’t be shared with any third parties.
6. Retention
We retain personal information for as long as needed to deliver the Service, satisfy legal or accounting obligations, and defend or establish legal claims. When no longer needed for those purposes, we delete or de-identify it.
7. Your choices
- Opt out of marketing. Use the unsubscribe link in any marketing email, or contact us at the address below.
- Access, correct, or delete your information. Contact us at the address below; see Section 9 for state-specific rights.
- Cookies. See our Cookie Notice for how to control analytics cookies through your browser.
8. Security
We use technical and organizational safeguards designed to protect the personal information we collect. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.
9. State privacy rights notice
Residents of states with comprehensive consumer privacy laws — including California, Colorado, Connecticut, and Virginia, among others — may have some or all of the following rights, subject to the exceptions in those laws: to know what personal information we’ve collected about you and why; to access a copy of it; to correct inaccurate information; to delete it; to opt out of targeted advertising or profiling; and to be free from discrimination for exercising these rights.
We do not sell personal information for money.
[CONFIRM before publishing: confirm whether Google Analytics is configured with Google Signals or ad-conversion linking enabled — if so, that configuration can count as a "sale" or "share" of personal information for cross-context behavioral advertising under the CCPA/CPRA and comparable state laws, which would require us to add a working opt-out mechanism (and honor the Global Privacy Control signal) rather than the "we do not sell" statement above. As currently implemented, the Site has no cookie-consent banner and no GPC-handling code, and Google Analytics and Microsoft Clarity load unconditionally on every page. That is a real gap against most of these state laws' opt-out expectations, not just a drafting placeholder — recommend closing it before this policy is published live.]

California Shine the Light. California residents may request, once per year and free of charge, information about any personal information we disclosed to third parties for their direct marketing purposes in the preceding calendar year. Email privacy@buildwithaplan.com with “Shine the Light Request” in the subject line.
10. International visitors
We are based in the United States and our service providers operate primarily in the United States. If you access the Site from outside the United States, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your jurisdiction.
11. Children
The Service is not intended for anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will delete it.
12. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. Material changes will be reflected by updating the effective date above and, where appropriate, a notice on the Site. Your continued use of the Site after an update means you accept the revised policy.
